Kyiv Residents Granted Free Access to Dnipro Embankment

The Kyiv prosecution has won a court case defending the right of all citizens to freely access the Dnipro embankment, which had been illegally claimed by residents of a luxury housing complex. The Supreme Court agreed with the prosecution's arguments and annulled the private ownership of the bank protection structures in the Berkovshchyna area, covering an area of more than 2,3 thousand square meters.
This pertains to the embankment near the residential complex located at Dniprovska Embankment, 14, in the Darnytsia district. The owners of the hydraulic structures had set up barriers and gates, restricting access to the river for those wishing to take a walk but not residing in the complex.

The hydraulic structures, according to technical documentation, span almost 500 square meters and serve to prevent erosion. In 2020, the private company registered its ownership rights to these structures. However, these bank reinforcements are situated on a communal land plot of the water fund, exceeding 3.1 hectares, valued at over 67 million UAH, within the protective coastal strip of the Dnipro River. In filing the lawsuit, the prosecutor emphasized that the registration of private ownership rights over the hydraulic structures results in the removal of the land plot from communal ownership and imposes restrictions on residents’ free access to the Dnipro River.

The Supreme Court concurred with the prosecutor's arguments: ownership rights to the hydraulic structure cannot be registered to anyone. Thus, the court concluded the case, affirming that access to the Dnipro embankment should be available to all, not just the residents of a single housing complex.
